Lawyer Robert Prignoli alleged he was “poisoned” by a “hazardous and toxic stew” of chemicals while swimming in the pool at LA Fitness in Travis. Prignoli said he’s moved to vacate a ruling awarding him $2,500 in damages; he had sought $150,000.
STATEN ISLAND, N.Y. — A West Brighton-based lawyer made a big splash last year when he sued a Travis gym for $5 million, alleging he was “poisoned” by chemicals in its pool.
As it turns out, a court-appointed referee gave Robert Prignoli a drop in the bucket.
Special Referee Susan Quirk recently awarded Prignoli $2,500 for skin rashes, “severe” hair loss, eye irritation, loss of taste and smell and other problems he allegedly suffered while swimming in the LA Fitness pool in January 2014.
” has failed to produce sufficient evidence of a cognizable nexus between his alleged injuries and the elevated levels of chlorine and pH subsequently detected in pool water to constitute the sole proximate cause of whatever injuries he may have sustained,” wrote Quirk.
Still, she said, while Prignoli’s injuries were “transitory” in nature, the chemical composition of LA Fitness’ pool water “cannot be excluded as a contributing factor.”
Prignoli, who had originally sought $5 million in damages, had reduced his demand to $150,000 at the inquest she held, said Quirk.
But the lawyer is having a hard time swallowing Quirk’s ruling and said he’s filed a motion to vacate it.

La Fitness Seizes The Moment Of Big
Many retailers have capitalized on the spike in shopping center vacancies to upgrade to better locations and negotiate favorable rents. In addition, for some expanding chains, the downturn has proven to be a time to upgrade their status in the eyes of landlords from strong inline tenant to reliable anchor.
Executives at LA Fitness, an Irvine, Calif.-based fitness club operator, have known for years that its locations in retail centers have performed well, according to Bill Horner, senior vice president and chief real estate officer with the firm.
In the past, however, retail landlords sometimes were reluctant to sign deals with fitness clubs out of a concern that they would eat into the parking needs of other tenants by locking up spaces for long amounts of time without providing any boost in sales-per-square-foot figures.
In some cases, other tenants, particularly grocers, stipulated that they didnt want fitness clubs as co-tenants, says Michael Kinsella, senior vice president and senior market officer for Florida with Regency Corp., a Jacksonville, Fla.-based shopping center REIT. Another strike against gyms is that they usually require extensive build-outs. So during the boom years, if given a choice, landlords would often opt to lease to traditional retailers.
But times have changed.
In addition, fitness clubs have proven their worth as traffic generators, dispelling the notion that they dont help drive dollars to other tenants bottom lines.

Im blessed & cursed to be in a state with open gyms . Focusing ONLY on pools:
Im driving to multiple locations to find lines at the pools and giving up. I made the suggestion to a regional manager and through their app to allow us to reserve pool lanes like you can with racquetball courts. Additionally, I suggested they review US Masters guidelines but to no success . Their response has been silence or thx for the suggestion.
Each time I go to a gym, Ill make the suggestions if I see different staff.
Today, my local club said they are limiting swims to 25 minutes if people are waiting!!!
Id switch gyms but 24 hour closed most near me and all masters programs are closed or majorly inconvenient . I dont have a quit them mentality but offer positive suggestions

Swimmer Describes Saving Driver Who Crashed Into Pool At North Seattle La Fitness
SEATTLE
Noah Schlenk was doing morning laps in the LA Fitness pool in north Seattle when something large crashed into the lane next to him.;
At first he thought someone had thrown something into the pool. It turned out to be a car.;
A vehicle crashed into the building around 8 a.m. Three people were in the pool at the time. No injuries were reported. ;
The car was almost completely submerged. Schlenk said the driver looked like he was in shock as he and another witness worked to pull him out of the vehicle.;
First responders have not released details on the cause of the crash. ;
No arrests have been made in connection with the incident.;
Most of the gym reopened around to clients around 4 p.m. Monday. The pool will remain closed for now as clean-up continues.;
Injured After Car Crashes Through Centerville La Fitness Lands In Pool
CENTERVILLE, Ohio Two people escaped with justminor injuries after a driver crashed his car through a wall at LA Fitness inCenterville and landed in the pool.
Centerville Police tell 2 NEWS it happened around 2:50 pm atthe gym located at 45 W. Alex Bell Road.
Initial investigation suggests that the driver was parking their car outside the facility when they somehow lost control and wound up crashing through the wall.
There were members swimming inside at the time, and one ofthose swimmers suffered minor injuries, according to Sgt. Kaercher.
When asked what caused the driver to lose control, Sgt.Kaercher says he does not believe medical issues were the cause, but ratherdriver error.
The driver of the car also received non-life threateninginjuries.
Sgt. Kaercher says all things considered, the situationcould have turned out to be much worse.
A gym employee says the pool area is closed, but the rest of the gym is still open.

Car Crashes Into La Fitness Ends Up In Pool
A car crashed through a glass door and into the pool of a North Seattle LA Fitness Monday morning after police say a man accidentally stepped on the gas pedal while parking.
The Seattle Fire Department was called at 7:42 a.m. to the LA Fitness located in the;13000 block of Aurora Avenue.
A 69-year-old man was parking his car in the lot just outside the gym building when he unintentionally stepped on the gas pedal instead of the brake, according to Seattle police, who said the jumped the curb, veered into the glass door and crashed into the pool.
Swimmer Noah Schlenk said he and another man were swimming at the time while a third man was jogging in the water. Fortunately, the car didn’t hit any of them.
“I’ve been a lifeguard for maybe five or six years now and I’ve never had a car, like, fall into the pool before!,” Schlenk said.
He said he was swimming when he saw tires in the water.
“My first thought was, ‘Oh, my God, where’s the guy in this lane? Is he underneath the car?” he said. “I look over at the other side of the pool and he’s safe. He’s fine.”
He said the two of them teamed up to pull the driver out of the car.
“As soon as we open the back door, all the water comes flooding in,” he said. “We’ve got to get him out as quick as we can.”
The man was disoriented and seemed to be in shock, Schlenk said, but was unhurt.
“The guy was, like, I need to get my phone,'” he said. “And , ‘We need to get you out first.'”
