Migrant Farmhand Convicted Of Murdering 20

DES MOINES, Iowa A judge on Monday rejected a convicted mans request for a new trial in the 2018 killing of University of Iowa student Mollie Tibbetts, whose body was found in a cornfield weeks after she disappeared while out for a run near her small hometown.

Judge Joel Yates ruling cleared the way for sentencing to proceed Aug. 30 in the trial of Cristhian Bahena Rivera, who was convicted in May of first-degree murder in Tibbetts death. The former farmhand, who came to the U.S. illegally as a teenager, faces a sentence of life in prison.

Yates rejected efforts by Bahena Riveras attorneys to implicate others, saying much of the evidence they presented after he was convicted was known to them before the verdict was handed down. To grant a new trial, any additional evidence would have to be new and revealed after the verdict, he wrote.

The judge also said many of the new allegations conflicted with trial testimony and evidence presented by Bahena Riveras own witnesses.

In reviewing the evidence and testimony provided at trial, the court finds the verdict was not contrary to the weight of the evidence, Yates wrote.

During questioning by police, Bahena Rivera acknowledged that he encountered Tibbetts as she was running near her small eastern Iowa hometown of Brooklyn and he led investigators to the field where her body lay hidden under cornstalks.

Attorneys for Bahena Rivera did not immediately reply to messages seeking comment.

This summer, Westchester County will be opening four public pools. On Friday, June 26 Saxon Woods Pool in White Plains and Sprain Ridge Pool in Yonkers will open followed by Willson Woods Pool in Mount Vernon and Tibbetts Brook Pool in Yonkers on July 3 all with some slight modifications to help ensure safety in the age of Covid-19.

Modifications include:

  • No Aqua Playground at Saxon Woods Pool.
  • No Aqua Splash Pad at Sprain Ridge Pool
  • No Waves in the Wave Pool or Aqua Playground/Splash Pad at Willson Woods Pool
  • No Lazy River Tubes, Aqua Playground, Water Slides or Basketball Court at Tibbetts Brook Park Pool

To further ensure safety, the pools will follow New York State and Westchester County Department of Health regulations of 50% maximum occupancy. The pools will be first come first serve entry with two public pool sessions throughout the day.

Saxon Woods Sprain Ridge Pools In Westchester To Open Friday

Two Westchester County pools will be open starting Friday : Saxon Woods in White Plains and the Sprain Ridge pool complex in Yonkers.

The plan is to open two more Westchester pools next week.

It’s welcome news for families looking for summer fun, especially with temperatures expected to threaten 90 degrees this weekend, but there will be strict protocols in place.

Both pools will be capped at 50 percent capacity, which equate to 1,400 people in Saxon Woods and 700 to 800 people in the Sprain Ridge pool complex, Westchester County Parks Department Commissioner Kathleen O’Connor said on Thursday.

Masks must be worn when getting snacks or going to the bathroom, and employees will enforce social distancing in and out of the pools, O’Connor said.

The pool will be open in two sessions. The first session will be open from 11 a.m. to 2 p.m. Parks employees will shut down the pools from 2 p.m. to 3 p.m. for intense sanitizing, and the pools will be reopened from 3 p.m. to 6 p.m.

Wristbands will go on sale starting at 9 a.m. until they sell out.

Willson’s Waves Mount Vernon

Tibbets Brook Pool Opening Today

If youre looking to cool off this weekend at a public pool, theres no better place than the newly-renovated Tibbetts Brook Pool. All of the countys community pools are open for the season starting today and remain open daily. Last year, the County Board approved a bond act for $9.25 million to fund the new pool complex at Tibbetts Brook Park. The current Yonkers pool is approximately 80 years old, has never received major renovations and is in a state of acute disrepair.

The renovations include a series of smaller water play areas, including a lazy river with sprays, water slides, an aquatic playground, new decking and a new concession/filter building. New piping and filter infrastructure will be state-of-the-art, remaking the pool as environmentally friendly, safe and energy efficient as current technology allows. The Tibbetts Brook Pool is another big example of how the county enhances the quality of life of our residents, said Board Chairman Ken Jenkins . This investment at Tibbetts Brook Pool by the Board of Legislators improves the environment and enhances the quality of life for Westchester residents. The construction work and added employment opportunities are vital for our region and the renovated pool will bring more users to Tibbetts Brook Park.

As summer days get hotter, Westchester locals will once again flock toward pools and beaches to splash around in the water and get their healthy dose of Vitamin D. In 2020, a limited reopening last year that attempted to balance COVID-19 protocols with keeping the countys urban and suburban populations from overheating. After the announcement that New York would lift most state-mandated pandemic restrictions, Westchesters public pools reopen this year for swimming, sans-social distancing and at full capacity.

Four public pools reopen for the summer beginning June 25, lasting through September 6. All pools will be open exclusively to county residents from 10 a.m. until 6:30 p.m. daily, with no admittance after 6 p.m. and no swim passes available this year. Fresh off a $30 million upgrade, the pool at FDR State Park covers nearly 1-acre of land. Completely rebuilt within the footprint of the old poolthe largest in the state park systemimprovements include the addition of a zero-depth entry section for toddlers and 26 kid-friendly spray features placed at various depths in the wading pool. The concession building has been renovated, a new poolside restroom has been constructed, and the landscape has been refreshed. The pool is open on weekends and holidays from 11am-6:30pm weekdays from 11am-5:30pm. Entry fees are $3 per person and there is a $10 fee for parking.

Westchester County Parks are Beginning to Reopen for the 2021 Season. Beginning Memorial Day: Playland Beach will be open during weekends through June 25th, and will be open seven days a week after June 25th.

Croton Point Beach will be open during weekends through June 25th and will be open Wednesday-Saturday after June 25th

Park passes are now full color, feature the Parks logo, and include a traditional credit card-sized pass as well as a smaller card that can be attached to a key chain. Both cards include a barcode, which identifies the user. While there is no photo on the card, the users photo, account number and information will appear on screen when scanned at park entrances.
