Is It Worth Filing A Lawsuit Against Your Hoa For A Pool Or Hot Tub

First Time Water Fill in Above Ground Pool – Hydra Hot Tubs & Pools

Whats worth more to you your time or your money?

If your HOA prohibits pools and spas of any kind, ask yourself how badly you want to take a dip. The legal expense may double the price of the pooland you may not even be successful in court. Plus, you do have the option to move if you feel its worth it.

Remember these thoughts and plan carefully when considering a pool or spa and working with your HOA. Good luck!

How Long Would It Take A Hot Tub Heater To Heat A Pool

So we already established a hot tub heater takes 6 hours from tap temperature to 100° in a hot tub.

BUT, most pool owners dont want their pools at 100°! In fact, most people who use pool heaters, keep their pools between 78° to 82°.

For math purposes, lets say you have an 18,000-gallon pool and want to get it to 80° from the 70° we said might be the average tap water temperature in your city.

Knowing a hot tub heater can do about 5 degrees an hour per every 500 gallons, it would take almost 3 days to heat your pool to 80°.

The next issue youll face, however, is that a lot of pool owners dont use pool covers the way hot tub owners do. So youll lose heat on the surface of the pool. For above-ground pool owners, youll also lose heat through the pool walls since they arent insulated like the underside of a hot tub.

The other issue youll likely face is that since a hot tub heater is designed for a much smaller system and far less water, and often not running 24/7, you would likely wear out the heating element inside your heater tube.

The average electric pool heater will probably only add about 60 cents an hour to your electric bill. So even if you run it 24/7, 365 days a year, youre looking at $438/month on top of your normal electric bill.

By comparison, a hot tub heater would probably use only about 75% of the electricity of a pool heater, so youd be looking at an extra $300/month on top of your bill.

First Understand The Purpose Of An Hoa

While you may already know this, its important to understand that an HOA is a mandatory association comprised of the homeowners in a neighborhood. When you purchase a home in a neighborhood with an HOA, you agree to abide by a set of rules known as covenants, conditions, and restrictions or commonly abbreviated CC& Rs.

These documents are specific to each HOA, and typically include requirements and restrictions on landscaping, maintenance, and other aspects for the outside of the home, like swimming pools.

Want to paint your house pink? Read the CC& Rs first to see if its permitted.

The purpose of an HOA and its CC& Rs is to protect, preserve, and enhance property values in the community.

The Temporary Nature Of Above

For many residents considering semi in-ground pools, while partially in-ground , these are often still considered above-ground pools due to the temporary nature of them.

For many HOAs, it likely comes down to upkeep, and the assumption that regular maintenance and cleanliness of semi in-ground or above-ground pools isnt as likely to be on-par with in-ground pools. Since in-ground pool owners have invested tens of thousands in the pumps, chemicals, and the construction of them, neglect is likely to be far less common than something more temporary in nature.

Again, while this many not be the case 100% of the time, it really comes down to protecting home values, limiting complaints, and HOAs simply not wanting to police and enforce dozens of these types of pools or hot tubs.

Can You Use A Hot Water Heater To Heat A Pool

This is the million-dollar question.

The short answer is yes, you probably could. Like most hot tub heaters, the average pool heater uses 2 plumbing connectors.

As Ive already discussed, though, youd likely wear out the heater element much faster, and it would take a lot longer to heat your pool. If youre drawn to using a hot tub heater for your pool due to the much lower cost, I get it!

A few hundred is a whole lot better than a few thousand!

But you may find, over time, that the wear and tear on your hot tub heater and the replacing of the heating element with some frequency arent worth it.

If you live somewhere as I do, where its warm a lot of the year , you might get away with it since youre actual need to heat the pool would be only a few months out of the year.

Without any heating, your pool water is not likely to get much above 75 on blazing hot days. And in spring and fall, it could easily not go above 68. For a lot of folks, thats pretty chilly.

Also know that by adding a pool cover, you can reduce heat loss by about 50%.

So its worth looking into! Solar slat covers even help heat your pool while covered. While theyre pricy, they generally pay for themselves within 2-3 in the energy youll save.

So, can you use a hot tub heater on a pool? Yes. Would I recommend it? Probably not.

Tip: Check With Your Hoa And Review The Cc& rs

Most CC& Rs will specify precisely whats required to have an in-ground pool plan approved. Check with the HOA and review the CC& Rs to see whats expected. You should also contact your HOA to establish some rapport and make a contact for any questions you have in the process.

Remember that in addition to the pool, youll have heavy equipment, materials, and workers in and out of your backyard for at least several weeks.

Know that all pool construction is messy, but an in-progress concrete pool is the worst. Thats because the builders are spraying concrete with a hose, and it gets everywhere. There will be dust and considerable over-spraying, which is why municipalities take pool installs so seriously.

Can You Use A Hot Tub Heater For A Pool

My wife and I plan to get a pool soon, but sometimes its a bit chilly for a dip in the pool. So Ive wondered can you use a hot tub heater for a pool?

I decided to investigate and heres what I learned:

A hot tub heater can heat 500 gallons of water between 3°-6° degrees per hour and has 4-5 kilowatts of power. Pool heaters are roughly 4 times as powerful, meaning a hot tub heater would take significantly longer to heat a pool. It also puts significant wear & tear on the hot tub heater. But it IS possible.

But theres more to know about the crucial differences between pool and hot tub heaters, how long a hot tub heater might take to heat a pool and how many gallons a minute a heater can handle.

So lets check it out!

How Does A Hot Tub Heater Work

Lets start by examining how a hot tub heater works.

Unlike the hot water heater in your house, a hot tub heater is more like the tankless hot water heaters that have become popular over the past decade. Since they dont have a holding tank, they simply heat on demand.

The pump pulls the water through the heater tube, warming it as it passes.

Then, between the insulation on the outside of your hot tub shell and the lid you keep closed on your hot tub when not in use, the heat loss is .

The actual heater in your hot tub is fairly small.

Not counting the box it comes in which often houses all the electrical connections for your entire system, the heater is only a couple of inches in diameter and maybe a foot long.

While theres a lot of brands of hot tub heaters, and a number of options for each brand, the average hot tub heater is probably between 4-5 kilowatts of power. They also are typically well under $500 for the complete control pack which includes the heater as well as the electrical system for all the hot tub components.

A pool heater, by comparison, typically runs a minimum of about $1,000, and often well into the thousands.

But to be fair, the pool heaters typically also contain the pump which in hot tub equipment is sold separately.

Unfortunately, for direct comparisons sake, most pool heaters show BTUs, not kilowatts. But doing a little conversion, Id say the average pool heater is probably between 15-20 kilowatts.

Reasons Hoas May Regulate Or Ban Above

Hot Tub Ideas that fit into your Landscape

Lets look at the legal implications with above-ground or inflatable pools as well as the reasoning behind why so many HOAs ban them.

Safety is generally the biggest issue for why HOAs ban above-ground pools. While there are generally regulations for fencing and self-closing gates for in-ground swimming pools, many municipalities may not have strict guidelines or even require permits for above-ground pools as a result, some HOAs dont allow above ground pools simply due to liability risk.

As a pool owner, you could be held liable for injury to guests and trespassers. By extension, the pool owners HOA may be brought into the litigation and may incur a portion of the fault if an incident occurs.

Flooding Potential And Property Management Risk Of Above

Pools can flood or damage property, especially in neighborhoods where houses are close together. The average 30-foot round above-ground pool holds approximately 18,500 gallons of water.

If a pool ruptures, it can also flood a neighbors property, damage expensive landscaping, and even damage a homes foundation Many HOA members dont want above-ground pools right on their property line for this very reason.

Best Practices For Installing A Pool Or Hot Tub With An Hoa

Simply call or email your HOA if you have questions about their pool policy. You should be able to find out: if pools are permitted the type of pools permitted the requirements for HOA approval and the most expedient way to make it happen .

It helps to do your homework if you are serious about installing a pool . Here are a few questions you should have handy if you approach your HOA:

  • Are there city zoning restrictions in addition to the CC& Rs?
  • How much will my homeowners insurance increase with a pool?
  • What safety features are required by the HOA and the city?
  • What type of schedule will the contractors keep?
  • What permits and approvals do I need from the city or county?
  • Do I understand pool injuries and premises liability?
  • Am I prepared to handle the maintenance of the pool or spa myself, or should I hire someone?
  • Can I design the spa to be part of the landscape, rather than an eyesore?
  • How much mess will construction create for the community?

Factor 5 Swimming Season

Intex PureSpa Bubble Hot Tub and Pool Combo » Petagadget

The length of the swim season is another thing to consider. In Ottawa, the average swimming season is short, usually no more than 4-5 months. While you could get a heater for your pool to extend the season out to around 6 months, the cost of heating an average pool is quite high easily costing several hundred dollars per month once overnight temperatures begin to drop.

A swim spa, on the other hand, is insulated against the cold and has a built-in heater. For this reason, you can very easily extend your swimming season to 8 or 9 months of the year, with some swim spa owners keeping their swim spas open all year long.

Verdict: If you want to extend your swimming season from 3-4 months to 6-12 months of the year, a swim spa is the much more cost effective choice.

How Many Gallons Per Minute Can A Hot Tub Heater Heat

The average hot tub holds somewhere between 300-600 gallons of water depending on how many people its designed to hold.

As I mentioned above, there are many sizes and types of hot tub heaters. So combined with the various sizes of hot tubs, and of course, a wide variety of weather, its hard to say 1 number that fits every situation.

That being said, the average hot tub heater will go up between 3 and 6 degrees each hour.

The other variable is whether you leave your heater on continuously or have it cycle on and off. But if youre filling up a medium-sized hot tub of 500 gallons from the hose, youre starting with water thats likely to be around 70°.

So to get to 100°, it would take about 6 hours.

That amounts to about 1.38 gallons a minute being heater by the average hot tub heater. But again, there are a lot of variables, so just use that as a guide.
